How Will Courts Determine Child Custody?
You and your spouse can negotiate a co-parenting arrangement with very little involvement of the court. The court will only get involved if you and your spouse cannot agree on issues such custody and visitation.
When the two parents cannot agree, the court will decide based on what it determines to be the best interests of the children. The court will consider 12 factors in making that determination:
- The length of time the child has lived in a stable, satisfactory environment and the desirability of maintaining continuity
- The moral fitness of the parties involved
- The home, school and community record of the child
- The willingness and ability of each parent to facilitate and encourage a close and continuing parent-child relationship between the child and the other parent
- The child's preference, depending on his or her age
