Can child custody be negotiated through the mediation process?

Whether you are just beginning the divorce process or you have already filed your paperwork, you may be interested to know the significant benefits of mediation, especially when it comes to arranging child custody and creating a parenting plan. When you and your spouse decide to part ways, you must continue a relationship with one another when co-parenting your children.

According to the American Bar Association, couples who undergo mediation often part ways on better terms than they do when they engage in traditional courtroom litigation. This may be due in part to the non-confrontational setup of mediation sessions, and the ability that parents have to create a child custody plan and schedule that meets both of their needs. Not only is this good for parents, but children may benefit most from this positive parental relationship. When parents are able to discuss matters involving their children in a positive and amicable way, children experience less stress and anxiety and may have an overall better quality of life.

When entering a mediation session, you and your spouse must be prepared to compromise with one another in an attempt to reach an agreement regarding the future wellbeing of your children. It is crucial to keep the best interests of the children in mind when customizing these plans. Children require the love and emotional support of both parents, and so it is essential that you work out a parenting plan that allows both parents to spend time with the child.
