What to Do with the Family Home During Divorce

When it comes time to divide the family home during the divorce process, divorcing couples may be unfamiliar with their options. Understanding the different ways that a home may be divided during divorce can help the property division process progress more smoothly.

Divorcing couples may want to take into account considerations such as their financial position, their housing situation and their overall familial situation when they decide which option to pursue when dividing the family home. Different options they may wish to evaluate when deciding what to do about the family home include:

  • One spouse buys out the other spouse: one spouse may wish to buy out the other spouse and keep the house. Divorcing spouses who decide on this option should be prepared that the home may need to be refinanced as part of this process.
  • Sell the house and split the proceeds: the spouses may wish to sell their home and share the proceeds. Divorcing options who decide on this option should be prepared that they will each need to secure housing.
  • Continue in joint ownership of the house: the spouses may wish to continue joint ownership of the home. This may be especially true if one spouse wishes to remain in the home for a period of time. The spouses will need to determine who will handle household-related expenses if they decide on this option.

Any decision about what to do with the family home during the divorce process should, of course, not be taken lightly. For that reason, how to divide a home and the options available to divorcing couples can be helpful to understand and be familiar with as the couple journeys through the property division process.
